TALLEY TRANS RETURN POLICY

There is a 30% restocking fee on all Talley Trans authorized returns within 30 days of purchase. This is in addition to any round-trip freight charges incurred.

No returns accepted after 30-days of purchase unless the return is for warranty reasons during the specified warranty period as determined by Talley Trans.

PLEASE NOTE: NO REFUNDS OF NEXT-DAY AIR OR 2ND-DAY AIR SHIPPING CHARGES FOR ANY REASON.

TALLEY TRANS WARRANTY

Warranties apply only to parts replacement. Warranties begin at date of purchase for thirty (30) days, unless otherwise specified. Longer warranties are available. If one of our parts fails, contact us during your warranty period, and we will arrange for a refund, repair or replacement of the defective part at our discretion.

If a replacement part cannot be obtained during your warranty period, a full refund will be issued to the original purchaser. Warranties are limited to the original parts purchaser and are non-transferable.

Parts not defective may be returned within 30 days of purchase, subject to acceptance, and a 30% handling charge. A Return Authorization Number (RAN) must be obtained from sales or customer service.

To be returnable, part(s) must be in the same condition as when sold, return freight prepaid.

ENGINES

Talley Trans warrants to the original purchaser that each engine sold shall be free, under normal use and periodic maintenance as set forth by the original manufacturer, from any defects in material and workmanship subject to the following terms and conditions:

• 1. Engine: As used herein, the term shall mean an engine supplied by us of the same original manufacturer and application as that delivered by us to its point of installation or point of retail sale.
• 2. Terms: Warranty shall exist for thirty (30) days. Motor homes are not covered by this limited warranty.
  • A) Product replaced under warranty: Any product replaced for warranty purposes will be warranted through the original product? warranty term only. This term begins upon the original product? installation date and applies to the original product? warranty mileage term.
• 3. Standards: Subject to limitations listed herein, we, at our option, shall repair or replace an engine within the warranty term after determination by us that the product is defective. All products are to be returned to our designated site for inspection. Products not returned to our designated site will not be warranted. Only the engine itself is covered by this warranty: no labor costs are provided for to either replace or repair an engine determined to be warrantable, unless specified.
• 4. Limitations: This warranty applies only to the basic engine long block and internal parts of the engine.
• This warranty shall not apply to or include any of the following:
  • A) Repair or replacement required as a result of any accident or misuse.
  • B) Repair or replacement of any engine accessory or service item, including specifically without limitations, all components of the cooling, fuel, electrical and engine control system and all points, plugs, oil filters and belts.
  • C) Any engine used for competition racing or related purposes.
  • D) Any engine which has been repaired or remodeled by any person other than an authorized dealer, or to which any device or accessory not conforming to original manufacturerӳ specifications has been installed.
  • E) Any engine on which the periodic maintenance services required by the original manufacturer have not been performed.
  • F) Warranty does not apply to any engine damage as a result of over-heating or lack of lubrication.
  • G) Warranty does not apply to engine damage resulting from pre-ignition or detonation. This includes, but is not limited to, melted or broken pistons, broken piston rings, damaged cylinder heads, etc. . .
• 5. Additional Limitations and Customer Obligations:
  • A) Important: Oil amp; filter must be changed after the first 600 miles of service.
  • B) Warning: On start-up: Readjust valves to manufacturers specifications after initial test drive, if applicable. Failure to perform these operations voids warranty.
• 6. Limited Liability: The liability of Talley Trans under this warranty is limited solely to the repair or replacement of defective parts or workmanship. Talley Trans shall not be liable for any labor costs, incidental, special, consequential, or exemplary damages, or for any service not expressly provided for herein, relating to or arising from the Talley Trans engine. Warranty is non-transferable.
• 7. Limited Warranty: This warranty is given in lieu of all other warranties, expressed or implied, including any warranty of merchantability or fitness for a particular purpose, on the part of Talley Trans or the dealer selling or installing the engine. No dealer, nor any agent or employee thereof is authorized to extend or enlarge this warranty.

TRANSMISSIONS

Talley Trans warrants to the original purchaser that each transmission sold shall be free, under normal use and periodic maintenance as set forth by the original manufacturer, from any defects in material and workmanship subject to the following terms and conditions:

• 1. Transmission: As used herein, the term shall mean a transmission supplied by us of the same original manufacturer and application as that delivered by us to its point of installation or point of retail sale.
• 2. Terms: Warranty shall exist for thirty (30) days.
• A) Product replaced under warranty: Any product replaced for warranty purposes will be warranted through the original productӳ warranty term only. This term begins upon the original productӳ installation date and applies to the original productӳ warranty mileage term.
• 3. Standards: Subject to limitations listed herein, we, at our option, shall repair or replace a transmission within the warranty term after determination by us that the product is defective. All products are to be returned to our designated site for inspection. Products not returned to our designated site will not be warranted. Only the transmission itself is covered by this warranty: no labor costs are provided for to either replace or repair a transmission determined to be warrantable, unless specified.
• 4. Limitations: This warranty applies only to the basic transmission and internal parts of the transmission. This warranty shall not apply to or include any of the following:
  • A) Repair or replacement required as a result of any accident or misuse.
  • B) Repair or replacement of any transmission accessory or service item, including specifically without limitations, all components such as metal clad seals, gaskets, filters & flywheels.
  • C) Any transmission used for competition racing or related purposes.
  • D) Any transmission which has been repaired or remodeled by any person other than an authorized dealer, or to which any device or accessory not conforming to original manufacturerӳ specifications has been installed.
  • E) Any transmission on which the periodic maintenance services required by the original manufacturer have not been performed.
  • F) Warranty does not apply to any transmission damage as a result of over-heating or lack of lubrication.
• 5. Additional Limitations and Customer Obligations:
  • A) Important: transmission fluid & filter must be changed immediately upon installation.
  • B) All gaskets & metal clad seals must be replaced prior to installation
• 6. Limited Liability: The liability of Talley Trans under this warranty is limited solely to the repair or replacement of defective parts or workmanship. Talley Trans shall not be liable for any labor costs, incidental, special, consequential, or exemplary damages, or for any service not expressly provided for herein, relating to or arising from the Talley Trans transmission. Warranty is non-transferable.
• 7. Limited Warranty: This warranty is given in lieu of all other warranties, expressed or implied, including any warranty of merchantability or fitness for a particular purpose, on the part of Talley Trans or the dealer selling or installing the transmission. No dealer, nor any agent or employee thereof is authorized to extend or enlarge this warranty.

TALLEY TRANS TRANSFER CASE LIMITED WARRANTY

TALLEY TRANS warrants to the original purchaser that each Transfer case sold by TALLEY TRANS shall be free of defects in material and workmanship under normal use and with periodical maintenance as set forth by the original manufacturer subject to the following terms and conditions:

• DEFINITIONS: Transfer case: As used in this warranty refers to the remanufactured assembly (Transfer case housing and all internal components) as supplied by TALLEY TRANS.
• TERM: This warranty shall exist as follows: Transfer cases (Light truck, under 11,000# GVW, passenger car): 90-days. The warranty term begins upon the date of installation. Subject to limitations listed herein, TALLEY TRANS, at its option, shall repair or replace a product within the warranty term after determination by TALLEY TRANS that the product is defective. All product Is to be returned to TALLEY TRANS for inspection. Product not returned to TALLEY TRANS will not be warranted. All repairs and/or replacements covered by this warranty must be authorized by TALLEY TRANS. Unauthorized repairs will not be paid. Any repair or replacement needed during the warranty period will be covered for the remainder of the original productsҠwarranty only.
• LIMITATIONS: This warranty applies to products originally supplied by TALLEY TRANS. This warranty does not apply to or include any of the following:
  • a) Damage as a result of OVERHEATING, LACK OF LUBRICATION or CONTAMINATION.
  • b) Repair or replacement required as a result of any accident or misuse.
  • C) Repair or replacement of any accessory or service item, including but not limited to: all components of the oil cooler and/or lines, electrical, suspension and steering In addition to drive shafts, C.V. joints, Transfer case mounts, carriers, external cables. Linkage, etc.
  • D) Any product used for competition or related purposes.
  • E) Any product to which a device or accessory not conforming to original manufacturers specifications has been Installed.
  • F) Any product on which periodic maintenance services required by the original manufacturer have not been performed.
  • G) Damage to Transfer case, transmission, engine and other assemblies or components resulting from improper Installation.
• LIMITED LIABILITY: TALLEY TRANS liability under this warranty is limited solely to the repair or replacement of defective product. TALLEY TRANS shall not be liable for any incidental, special, consequential or exemplary damages. Including but not limited to rental cars, towing fees or for any service not expressly provided for herein, relating to, or arising from the TALLEY TRANS product.
• LIMITED WARRANTY: This warranty is given in lieu of all other warranties, expressed or implied, including any warranty of merchantability, or fitness for a particular purpose, on the part of TALLEY TRANS or the dealer installing the Transfer case. No dealer nor any agent or employee thereof is authorized to extend or modify this warranty. No parts (seals, gaskets, etc.) are supplied for customer installation.
• ADDITIONAL OWNER/USER OBLIGATIONS: Flush the Transfer case prior to Installation. Replace all external seals. Follow all Installation instructions supplied with the Transfer case. FAILURE TO PERFORM THESE BASIC OPERATIONS MAY RESULT IN A VOID.

CONTROL MODULE (COMPUTER BOXES), ENGINE (ECM/PCM, GEM (OR) SMEC), TRANSMISSION (TCM), ABS (ANTI-LOCK BRAKE SYSTEM), AIRBAG, or Climate Control Unit, Limited Warranty

ELECTRONIC CONTROL UNIT (herein referred to as Module) : A digital computer that controls engine (and sometimes transmission, brake, climate or other car system) functions based on data received from various sensors. Examples used by some manufacturers include Electronic Brake Control Module (EBCM), Engine Control Module (ECM), Powertrain Control Module (PCM), Vehicle Control Module (VCM) Transmission Control Module (TCM), Anti-lock Brake System Module (ABSM OR EBCM).

Talley Trans warrants to the original purchaser that each module sold shall be free, under normal use as set forth by the original manufacturer, from any defects in material and workmanship subject to the following terms and conditions:

• 1. Module: As used herein, the term shall mean a module supplied by us of the same original manufacturer and application as that delivered by us to its point of installation or point of retail sale.
• 2. Terms: Warranty shall exist for thirty (30) days. Product replaced under warranty: Any product replaced for warranty purposes will be warranted through the original productӳ warranty term only. This term begins upon the original productӳ installation date.
• 3. Standards: Subject to limitations listed herein, we, at our option, shall repair or replace a module within the warranty term after determination by us that the product is defective. All products are to be returned to our designated site for inspection. Products not returned to our designated site will not be warranted. Only the module itself is covered by this warranty: no labor costs are provided for to either replace or repair a module determined to be warrantable, unless specified.
• 4. Limitations: This warranty applies only to the module.
• 5. This warranty shall not apply to or include any of the following:
  • A) Repair or replacement required as a result of any accident or misuse.
  • B) Repair or replacement of any other accessory or service item, including specifically without limitations, all components of the cooling, fuel, electrical and engine control system except the module purchased from Talley Trans, Inc.
  • C) Any vehicle used for competition racing or related purposes.
  • D) Any vehicle which has been repaired or remodeled by any person other than an authorized dealer, or ASE or ASA certified mechanic to which any device or accessory not conforming to original manufacturerӳ specifications has been installed.
• 6. Limited Liability: The liability of Talley Trans under this warranty is limited solely to the repair or replacement of defective parts or workmanship. Talley Trans shall not be liable for any labor costs, incidental, special, consequential, or exemplary damages, or for any service not expressly provided for herein, relating to or arising from the Talley Trans module. Warranty is non-transferable.
• 7. Limited Warranty: This warranty is given in lieu of all other warranties, expressed or implied, including any warranty of merchantability or fitness for a particular purpose, on the part of Talley Trans or the dealer selling or installing the module. No dealer, nor any agent or employee thereof is authorized to extend or enlarge this warranty.
